Data Protection Declaration

Our website may be used without entering personal information. Different rules may apply to certain services on our site, which are explained separately below. We collect personal information from you (e.g., name, address, email address, telephone number, etc.) in accordance with the provisions of German data protection statutes. Information is considered personal if it can be associated exclusively with a specific natural person. The legal framework for data protection can be found in the German Federal Data Protection Act (BDSG) and the Telemedia Act (TMG). The provisions below serve to provide information on the manner, extent, and purpose of collecting, using, and processing personal information by the provider. Please be aware that data transfer via the internet is subject to security risks and, therefore, complete protection against third-party access to transferred data cannot be ensured.

Data Collection on This Website

Responsible Party for Data Collection on This Website

The data processing on this website is carried out by the website operator. Their contact details can be found in the section “Notice concerning the responsible party” in this privacy policy.

How Do We Collect Your Data?

Your data will be collected on the one hand by you providing it to us. This can be, for example, data that you enter in a contact form.

Other data is collected automatically or after your consent when visiting the website by our IT systems. These are mainly technical data (e.g., internet browser, operating system, or time of page view). This data is collected automatically as soon as you enter this website.

What Do We Use Your Data For?

Part of the data is collected to ensure the proper functioning of the website. Other data can be used to analyze your user behavior.

What Rights Do You Have Regarding Your Data?

You have the right to receive information about the origin, recipient, and purpose of your stored personal data free of charge at any time. You also have a right to request the correction or deletion of this data. If you have given your consent to data processing, you can revoke this consent at any time for the future. You also have the right, under certain circumstances, to request the restriction of the processing of your personal data. Furthermore, you have the right to file a complaint with the competent supervisory authority.

For this purpose, as well as for further questions on the subject of data protection, you can contact us at any time.

You can adjust your cookie settings via the “Cookies” option at the bottom of this website.

Analysis Tools and Third-Party Tools

When visiting this website, your surfing behavior can be statistically evaluated. This is mainly done with so-called analysis programs.

Detailed information on these analysis programs can be found in the following privacy policy.

General Information and Mandatory Information

Data Protection

The operators of these pages take the protection of your personal data very seriously. We treat your personal data confidentially and in accordance with the statutory data protection regulations and this privacy policy.

When you use this website, various personal data are collected. Personal data is data with which you can be personally identified. This privacy policy explains what data we collect and what we use it for. It also explains how and for what purpose this happens.

We point out that data transmission over the internet (e.g., communication by e-mail) can have security gaps. Complete protection of the data from access by third parties is not possible.

Notice Concerning the Responsible Party

The responsible party for data processing on this website is:

DAS IST Verlag
C. Alexander Walle
Arfelder Hauptstraße 51
D-57319 Bad Berleburg
Germany

Telephone: +49 2755 224611
Email: [email protected]

The responsible party is the natural or legal person who, alone or jointly with others, decides on the purposes and means of processing personal data (e.g., names, e-mail addresses, etc.).

Storage Duration

Unless a more specific storage period has been stated within this privacy policy, your personal data will remain with us until the purpose for the data processing no longer applies. If you assert a legitimate request for deletion or revoke your consent to data processing, your data will be deleted unless we have other legally permissible reasons for storing your personal data (e.g., retention periods under tax or commercial law); in the latter case, the deletion takes place after these reasons cease to apply.

General Information on the Legal Basis for Data Processing on This Website

If you have consented to data processing, we process your personal data based on Art. 6(1)(a) GDPR or Art. 9(2)(a) GDPR if special categories of data are processed according to Art. 9(1) GDPR. In the case of explicit consent to the transfer of personal data to third countries, the data processing is also based on Art. 49(1)(a) GDPR. If you have consented to the storage of cookies or to the access to information on your device (e.g., via device fingerprinting), the data processing is additionally based on § 25(1) TTDSG. The consent is revocable at any time. If your data is required for the fulfillment of a contract or for the implementation of pre-contractual measures, we process your data based on Art. 6(1)(b) GDPR. Furthermore, we process your data if this is necessary to fulfill a legal obligation based on Art. 6(1)(c) GDPR. The data processing can also be based on our legitimate interest according to Art. 6(1)(f) GDPR. Information on the relevant legal basis in each individual case is provided in the following sections of this privacy policy.

Notice on Data Transfer to the USA

We use tools from companies based in the USA. When these tools are active, your personal data may be transferred to the US servers of these companies. We point out that the USA is not a safe third country in the sense of EU data protection law. US companies are obliged to hand over personal data to security authorities without you, as the data subject, being able to take legal action against this. It cannot be ruled out that US authorities (e.g., intelligence services) may process, evaluate, and permanently store your data located on US servers for surveillance purposes. We have no influence on these processing activities.

Recipients of Personal Data

In the context of our business activities, we work with various external parties. This may also involve the transfer of personal data to these external parties. We only pass on personal data if this is necessary within the scope of the contract execution, if we are legally obliged to do so (e.g., transfer of data to tax authorities), if we have a legitimate interest in the transfer (Art. 6(1)(f) GDPR), or if another legal basis permits the data transfer. When using processors, we only transfer personal data of our customers based on a valid contract on order processing. In the case of joint processing, a contract on joint processing is concluded.

Revocation of Your Consent to Data Processing

Many data processing operations are only possible with your explicit consent. You can revoke an already given consent at any time. The legality of the data processing carried out until the revocation remains unaffected by the revocation.

Right to Object to Data Collection in Special Cases and Direct Advertising (Art. 21 GDPR)

If the data processing is based on Art. 6(1)(e) or (f) GDPR, you have the right to object to the processing of your personal data at any time for reasons arising from your particular situation; this also applies to profiling based on these provisions. The respective legal basis on which processing is based can be found in this privacy policy. If you object, we will no longer process your personal data unless we can demonstrate compelling legitimate grounds for the processing that override your interests, rights, and freedoms or the processing serves to assert, exercise, or defend legal claims (objection under Art. 21(1) GDPR).

If your personal data is processed to carry out direct advertising, you have the right to object at any time to the processing of personal data concerning you for the purpose of such advertising; this also applies to profiling insofar as it is associated with such direct advertising. If you object, your personal data will then no longer be used for direct advertising purposes (objection under Art. 21(2) GDPR).

Right to File Complaints with Regulatory Authorities

In the event of violations of the GDPR, the data subjects have a right to file a complaint with a supervisory authority, particularly in the member state of their habitual residence, place of work, or the place of the alleged violation. The right to file a complaint exists without prejudice to other administrative or judicial remedies.

Right to Data Portability

You have the right to have data that we process automatically based on your consent or in fulfillment of a contract handed over to you or a third party in a common, machine-readable format. If you request the direct transfer of the data to another responsible party, this will only be done as far as it is technically feasible.

Information, Correction, and Deletion

Within the scope of the applicable statutory provisions, you have the right to free information about your stored personal data, its origin and recipient, and the purpose of the data processing and, if necessary, a right to correction or deletion of this data at any time. For this purpose, as well as for further questions on the subject of personal data, you can contact us at any time.

Right to Restriction of Processing

You have the right to request the restriction of the processing of your personal data. For this purpose, you can contact us at any time. The right to restriction of processing exists in the following cases:

  • If you dispute the accuracy of your personal data stored by us, we usually need time to verify this. For the duration of the verification, you have the right to request the restriction of the processing of your personal data.
  • If the processing of your personal data was

/is unlawful, you can request the restriction of data processing instead of deletion.

  • If we no longer need your personal data, but you need it for exercising, defending, or asserting legal claims, you have the right to request the restriction of the processing of your personal data instead of deletion.
  • If you have lodged an objection under Art. 21(1) GDPR, a balance must be struck between your and our interests. As long as it is not yet clear whose interests prevail, you have the right to request the restriction of the processing of your personal data.

If you have restricted the processing of your personal data, this data may only be processed – apart from its storage – with your consent or for the assertion, exercise, or defense of legal claims or to protect the rights of another natural or legal person or for reasons of important public interest of the European Union or a member state.

SSL or TLS Encryption

This site uses SSL or TLS encryption for security reasons and to protect the transmission of confidential content, such as orders or requests that you send to us as the site operator. You can recognize an encrypted connection by changing the address line of the browser from “http://” to “https://” and the lock symbol in your browser line.

If SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.

Objection to Advertising Emails

We hereby object to the use of contact data published as part of the imprint obligation to send unsolicited advertising and information materials. The operators of these pages expressly reserve the right to take legal action in the event of the unsolicited sending of advertising information, for example, through spam emails.

Data Collection on This Website

Cookies

Our internet pages use so-called “cookies.” Cookies are small data packets and do not harm your device. They are stored either temporarily for the duration of a session (session cookies) or permanently (permanent cookies) on your device. Session cookies are automatically deleted after your visit. Permanent cookies remain on your device until you delete them yourself or an automatic deletion is carried out by your web browser.

Cookies can be provided by us (first-party cookies) or by third parties (so-called third-party cookies). Third-party cookies enable the integration of certain services provided by third parties within websites (e.g., cookies for processing payment services).

Cookies have various functions. Many cookies are technically necessary, as certain website functions would not work without them (e.g., the shopping cart function or the display of videos). Other cookies can be used to evaluate user behavior or for advertising purposes.

Cookies that are necessary to carry out the electronic communication process, to provide certain functions desired by you (e.g., for the shopping cart function), or to optimize the website (e.g., cookies for measuring the web audience) are stored based on Art. 6(1)(f) GDPR unless another legal basis is specified. The website operator has a legitimate interest in storing necessary cookies for the technically error-free and optimized provision of its services. If consent to the storage of cookies and comparable recognition technologies has been requested, processing is carried out exclusively based on this consent (Art. 6(1)(a) GDPR and § 25(1) TTDSG); the consent can be revoked at any time.

You can set your browser to inform you about the setting of cookies and allow cookies only in individual cases, exclude the acceptance of cookies for certain cases or in general, and activate the automatic deletion of cookies when closing the browser. When deactivating cookies, the functionality of this website may be limited.

Which cookies and services are used on this website can be found in this privacy policy.

Server Log Files

The provider of the pages automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are:

  • Browser type and browser version
  • Operating system used
  • Referrer URL
  • Hostname of the accessing computer
  • Time of the server request
  • IP address

This data is not merged with other data sources.

The collection of this data is based on Art. 6(1)(f) GDPR. The website operator has a legitimate interest in the technically error-free presentation and the optimization of its website – for this purpose, the server log files must be recorded.

Contact Form

If you send us inquiries via the contact form, your details from the inquiry form, including the contact details you provided there, will be stored by us for the purpose of processing the inquiry and in case of follow-up questions. We do not pass on this data without your consent.

The processing of this data is based on Art. 6(1)(b) GDPR if your request is related to the fulfillment of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, the processing is based on our legitimate interest in the effective processing of the inquiries addressed to us (Art. 6(1)(f) GDPR) or on your consent (Art. 6(1)(a) GDPR) if this has been requested; the consent can be revoked at any time.

The data you enter in the contact form will remain with us until you request us to delete it, revoke your consent to storage, or the purpose for data storage no longer applies (e.g., after your request has been processed). Mandatory statutory provisions – in particular retention periods – remain unaffected.

Inquiry by Email, Telephone, or Fax

If you contact us by email, telephone, or fax, your request, including all resulting personal data (name, request), will be stored and processed by us for the purpose of processing your request. We do not pass on this data without your consent.

The processing of this data is based on Art. 6(1)(b) GDPR if your request is related to the fulfillment of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, the processing is based on our legitimate interest in the effective handling of the inquiries sent to us (Art. 6(1)(f) GDPR) or on your consent (Art. 6(1)(a) GDPR) if this has been requested; the consent can be revoked at any time.

The data you send to us via contact inquiries will remain with us until you request us to delete it, revoke your consent to storage, or the purpose for data storage no longer applies (e.g., after your request has been processed). Mandatory statutory provisions – in particular statutory retention periods – remain unaffected.

Social Media

Instagram

Functions of the Instagram service are integrated on this website. These functions are provided by Meta Platforms Ireland Limited, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland.

If the social media element is active, a direct connection is established between your device and the Instagram server. Instagram receives information about your visit to this website.

If you are logged into your Instagram account, you can click the Instagram button to link the content of this website to your Instagram profile. This allows Instagram to associate the visit to this website with your user account. We point out that we, as the provider of the pages, have no knowledge of the content of the transmitted data and its use by Instagram.

As far as consent (consent) has been obtained, the use of the above-mentioned service is based on Art. 6(1)(a) GDPR and § 25 TTDSG. The consent is revocable at any time. As far as no consent has been obtained, the use of the service is based on our legitimate interest in achieving the broadest possible visibility on social media.

As far as personal data collected on our website is transferred to Facebook or Instagram and processed by Facebook or Instagram, we and Meta Platforms Ireland Limited, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland, are jointly responsible for this data processing (Art. 26 GDPR). The joint responsibility is limited to the collection of the data and its transfer to Facebook or Instagram. The processing by Facebook or Instagram after the transfer is not part of the joint responsibility. The obligations incumbent on us jointly have been set out in a joint processing agreement. The wording of the agreement can be found at: https://www.facebook.com/legal/controller_addendum. According to this agreement, we are responsible for providing the data protection information when using the Facebook or Instagram tool and for the data protection-compliant implementation of the tool on our website. For the data security of the Facebook or Instagram products, Facebook is responsible. Data subject rights (e.g., requests for information) regarding the data processed by Facebook or Instagram can be asserted directly with Facebook. If you assert the data subject rights with us, we are obliged to forward them to Facebook.

The data transfer to the USA is based on the standard contractual clauses of the EU Commission. Details can be found here: https://www.facebook.com/legal/EU_data_transfer_addendum, https://privacycenter.instagram.com/policy/ and https://de-de.facebook.com/help/566994660333381.

Pinterest

We use elements of the social network Pinterest, operated by Pinterest Europe Ltd., Palmerston House, 2nd Floor, Fenian Street, Dublin 2, Ireland, on this website.

data may include your IP address, the address of the visited websites that also contain Pinterest functions, the type and settings of the browser, the date and time of the request, your use of Pinterest, and cookies.

Further information on the purpose, scope, and further processing and use of the data by Pinterest, as well as your rights in this respect and setting options for protecting your privacy, can be found in Pinterest’s privacy policy: pinterest.com/privacy.

Facebook Plugins (Like Button)

Our website employs components provided by facebook.com. Facebook is a service of Facebook Inc., 1 Hacker Way, Menlo Park, California 94025, USA. You can find an overview of Facebook plugins at: http://developers.facebook.com/docs/plugins/. Each time our website receives an access request equipped with a Facebook component, the component prompts your browser to download an image of this Facebook component. Through this process, Facebook is informed precisely which page of our website is being visited. When you access our site while logged into Facebook, Facebook uses information gathered by this component to identify the precise page you are viewing and associates this information with your personal account on Facebook. Whenever you click on the “Like” button, for example, or enter a comment, this information is transmitted to your personal account on Facebook and stored there. In addition, Facebook is informed of your visit to our website. This occurs regardless of whether you click on a component or not. The data protection policies of Facebook provide additional information, in particular about the collection and use of data by Facebook, your rights in this regard, and the options available to you for protecting your privacy: https://de-de.facebook.com/about/privacy/. If you wish to prevent the transfer to and storage of data by Facebook about you and your interaction with our website, you must first log out of Facebook before visiting our website.

YouTube

Our website uses plugins from the YouTube site operated by Google. The operator of the pages is YouTube, LLC, 901 Cherry Ave., San Bruno, CA 94066, USA. If you visit one of our pages featuring a YouTube plugin, a connection to the YouTube servers is established. Here, the YouTube server is informed about which of our pages you have visited. If you are logged into your YouTube account, YouTube allows you to associate your browsing behavior directly with your personal profile. You can prevent this by logging out of your YouTube account. Further information about handling user data can be found in the YouTube privacy policy at: google.com/privacy.

Newsletter

Newsletter Data

If you want to receive the newsletter offered on the website, we require your email address as well as information that allows us to verify that you are the owner of the provided email address and agree to receive the newsletter. Further data will not be collected or only on a voluntary basis. We use this data exclusively for sending the requested information and do not pass it on to third parties.

The processing of the data entered in the newsletter registration form is based solely on your consent (Art. 6(1)(a) GDPR). The given consent to the storage of the data, the email address, and their use for sending the newsletter can be revoked at any time, for example via the “unsubscribe” link in the newsletter. The legality of the data processing operations already carried out remains unaffected by the revocation.

The data stored with us for the purpose of receiving the newsletter will be stored by us until your subscription is canceled and deleted after unsubscribing from the newsletter. Data stored by us for other purposes remains unaffected.

After unsubscribing from the newsletter distribution list, your email address may be stored by us or the newsletter service provider in a blacklist to prevent future mailings. The data from the blacklist will only be used for this purpose and will not be merged with other data. This serves both your interest and our interest in complying with the legal requirements for sending newsletters (legitimate interest in the sense of Art. 6(1)(f) GDPR). The storage in the blacklist is indefinite. You can object to the storage if your interests outweigh our legitimate interest.

We use the MailChimp component to send our newsletters. MailChimp is a service provided by The Rocket Science Group, LLC, 512 Means Street, Suite 404, Atlanta, GA 30318, USA. The data stored when you registered for the newsletter (email address, name, IP address, and date and time of registration) will be sent to a server operated by The Rocket Science Group in the United States and stored there in compliance with the “EU-US Privacy Shield”. Further information about the data protection offered by MailChimp can be found at: mailchimp.com/privacy.

Plugins and Tools

Google Analytics

We use Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses “cookies,” which are text files placed on your computer, to help the website analyze how users use the site. The information generated by the cookie about your use of the website (including your IP address) will be transmitted to and stored by Google on servers in the United States. In case of activation of the IP anonymization, Google will truncate/anonymize the last octet of the IP address for Member States of the European Union as well as for other parties to the Agreement on the European Economic Area. Only in exceptional cases is the full IP address sent to and shortened by Google servers in the USA. On behalf of the website provider, Google will use this information for evaluating your use of the website, compiling reports on website activity for website operators, and providing other services relating to website activity and internet usage to the website provider. Google will not associate your IP address with any other data held by Google. You may refuse the use of cookies by selecting the appropriate settings on your browser. However, please note that if you do this, you may not be able to use the full functionality of this website. Furthermore, you can prevent Google’s collection and use of data (cookies and IP address) by downloading and installing the browser plug-in available at https://tools.google.com/dlpage/gaoptout?hl=en-GB. Please note that on this website, Google Analytics code is supplemented by “gat._anonymizeIp();” to ensure an anonymized collection of IP addresses (so-called IP-masking).

Cloudflare Turnstile

We use Cloudflare Turnstile (hereinafter “Turnstile”) on this website. The provider is Cloudflare Inc., 101 Townsend St., San Francisco, CA 94107, USA (hereinafter “Cloudflare”).

Turnstile is used to verify whether data entered on this website (e.g., in a contact form) is entered by a human or by an automated program. For this purpose, Turnstile analyzes the behavior of the website visitor based on various characteristics.

This analysis starts automatically as soon as the website visitor enters a website with Turnstile activated. For analysis, Turnstile evaluates various information (e.g., IP address, duration of the visitor’s stay on the website, or user mouse movements). The data collected during the analysis is forwarded to Cloudflare.

The storage and analysis of the data are based on Art. 6(1)(f) GDPR. The website operator has a legitimate interest in protecting its web offerings from abusive automated spying and from spam. If a corresponding consent was requested, processing is carried out exclusively based on Art. 6(1)(a) GDPR and § 25(1) TTDSG, as far as the consent includes the storage of cookies or access to information in the user’s terminal device (e.g., device fingerprinting) in the sense of the TTDSG. The consent can be revoked at any time.

The data processing is based on the standard contractual clauses, which can be found here: https://www.cloudflare.com/cloudflare-customer-scc/.

Further information on Cloudflare Turnstile can be found in the Cloudflare privacy policy: https://www.cloudflare.com/cloudflare-customer-dpa/.

The company is certified under the “EU-US Data Privacy Framework” (DPF). The DPF is an agreement between the European Union and the USA to ensure compliance with European data protection standards in data processing in the USA. Every company certified under the DPF undertakes to comply with these data protection standards. Further information can be obtained from the provider at the following link: https://www.dataprivacyframework.gov/s/participant-search/participant-detail?contact=true&id=a2zt0000000GnZKAA0&status=Active.

Customer Reviews

We send (automatic) follow-up emails (reminders) to customers who have purchased products from our shop to gather shop and product reviews. These reminders are sent using an independent service provider because reviews managed by online shops themselves are commonly perceived as biased or fake. We use the provider Customer Reviews Ltd (Registered in England and Wales) 71-75 Shelton Street, Covent Garden, London, England, WC2H 9JQ, Company No. 11364361. Their terms and conditions can be found here: cusrev.com/terms.
